Terms of Use

These Terms of Use ("Terms") constitute a legal agreement between you ("User") and Vision Research ("Developer") regarding your use of EyeTrainer (the "App"), a visionOS application. By downloading, installing, or using the App, you agree to be bound by these Terms.

Apple Inc. is not a party to these Terms. This End User License Agreement ("EULA") is solely between you and Vision Research. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.


1. License

Vision Research grants you a limited, non-exclusive, non-transferable license to use the App on any Apple-branded device that you own or control, subject to the usage rules set forth in the Apple App Store Terms of Service. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

2. Subscription Terms

EyeTrainer is offered on a subscription basis at $29 per year, managed through Apple's in-app purchase system (StoreKit 2).

3. Maintenance and Support

Vision Research, not Apple, is solely responsible for providing any maintenance and support services with respect to the App, as required under applicable law. To request support or report issues, contact us at contact@visionresearch.xyz. Apple has no obligation whatsoever to furnish any maintenance or support services.

4. Warranty

Vision Research is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Vision Research's sole responsibility.

5. Health and Medical Disclaimer

EyeTrainer is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. The App has not been evaluated or cleared by the U.S. Food and Drug Administration (FDA) or any other regulatory authority. EyeTrainer is designed for general visual training and perceptual exercise purposes only.

6. Product Liability and Claims

Vision Research, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

7. Intellectual Property

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Vision Research, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

8. Privacy and Data

EyeTrainer does not collect, transmit, or share any personal data. All user data — including exercise history and settings — is stored locally on your device using Apple's SwiftData framework and never leaves your device. No analytics, crash reporting, or third-party SDKs are included in the App.

Hand tracking is used solely to enable custom path drawing within the App's exercises. Hand tracking data is processed on-device and is not recorded or transmitted.

9. Export Compliance

By using the App, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Terms

You must comply with applicable third-party terms of service when using the App. This includes, without limitation, the Apple App Store Terms of Service and any terms applicable to the operating system or device on which the App runs.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Vision Research shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of vision improvement outcomes, arising out of or in connection with your use of the App, even if advised of the possibility of such damages. Vision Research's total liability to you for all claims arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

13. Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

14. Changes to These Terms

Vision Research reserves the right to update these Terms at any time. Continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review this page periodically.
